Terms of Service

These Terms of Service ("Terms") govern your use of DriveHub, a mobile application ("the App") developed and operated by ThePearlie Tech Co ("we", "our", "us"), available on iOS via the Apple App Store and on Android via Google Play. By downloading or using DriveHub, you agree to these Terms.

1. Eligibility

You must be at least 17 years old to use DriveHub (in line with App Store and Google Play age ratings). By using the App you confirm that you meet this requirement. DriveHub is not directed at children under 13, and we do not knowingly collect data from anyone under 13.

2. Licence to Use

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use DriveHub on devices you own or control, for your personal, non-commercial use, subject to these Terms.

You may not:

• Reverse-engineer, decompile, or disassemble the App;
• Rent, lease, sublicense, or resell the App;
• Use the App for any unlawful purpose or in violation of any traffic law;
• Attempt to gain unauthorised access to our servers or infrastructure.

3. Subscriptions and Purchases

3.1 Free Tier

DriveHub is free to download. The Free tier includes turn-by-turn navigation, basic AI questions, manual dashcam, one vehicle profile, and the last 10 trips. Free features are available indefinitely.

3.2 DriveHub Pro (Monthly)

DriveHub Pro is a subscription that unlocks all diagnostic, AI, safety, and in-car features. Billing is monthly. Your subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.

3.3 DriveHub Pro Lifetime

A one-time purchase that grants access to all Pro features (excluding AI Copilot after 12 months — see Section 3.4) for the lifetime of the App. "Lifetime" means as long as DriveHub is commercially available and you have not breached these Terms.

3.4 AI Copilot Add-On

The AI Copilot feature incurs real per-query costs to operate. Pro and Lifetime plans include unlimited AI for the first 12 months. After that period, a daily-question allowance is included at no extra charge; unlimited AI usage continues for an optional low monthly add-on fee.

3.5 Billing and Cancellation

• iOS: Billing is handled by Apple via StoreKit. Manage or cancel your subscription in iPhone Settings → [Your Name] → Subscriptions.
• Android: Billing is handled by Google via Google Play Billing. Manage or cancel in Google Play → Account → Subscriptions.
• We do not have access to your payment details at any point — all billing is managed by Apple or Google.
• Refunds are subject to Apple's or Google's respective refund policies. We do not issue direct refunds for subscription charges already processed.

4. Safety Features — Important Limitations

• Crash detection uses motion sensors and GPS to infer a collision. It may not detect every crash, and may occasionally produce false alerts. A confirmation countdown allows you to cancel an accidental trigger.
• SOS alerts send a message to the emergency contacts you configure. Delivery depends on the recipient's phone and mobile network connectivity — it is not a guaranteed channel.
• Dashcam recordings (iOS) loop-overwrite continuously. While crash detection locks the preceding 30 seconds, we cannot guarantee that footage is preserved in every situation.
• Fatigue detection is based on driving duration, not physiological measurement. It is a reminder only.

5. OBD-II Diagnostics Disclaimer

DriveHub reads data from your vehicle's OBD-II port via a third-party adapter. The diagnostic information displayed is provided for informational purposes only and does not constitute professional automotive advice. Always consult a qualified mechanic before making repair decisions based on OBD readings or fault codes shown in the App.

DriveHub is not responsible for any vehicle damage, financial loss, or personal injury resulting from actions taken or not taken based on information displayed in the App.

6. Navigation Disclaimer

Navigation is powered by Mapbox. Route data, toll estimates, speed camera alerts, and POI information may be inaccurate, incomplete, or out of date. Always exercise independent judgement when driving. We are not liable for any loss or damage resulting from following a route or acting on navigation data provided by the App.

7. AI Copilot

DriveHub AI is powered by Anthropic's Claude API. Responses are generated by an AI model and may occasionally be inaccurate, incomplete, or inappropriate. Do not treat AI Copilot responses as professional automotive, medical, legal, or financial advice. Your messages are sent to Anthropic to generate responses — see our Privacy Policy for details.

8. User Data and Privacy

Your use of DriveHub is governed by our Privacy Policy, which is incorporated into these Terms by reference. In summary: we do not sell your data, we do not use advertising SDKs, and the majority of your data is stored on your own device.

9. Third-Party Services

DriveHub integrates with:

• Anthropic — AI responses (Claude API)
• Mapbox — maps and navigation
• Apple (iCloud / CloudKit / StoreKit) — sync, storage and billing on iOS
• Google (Play Billing) — billing on Android
• NHTSA — public vehicle VIN lookup

These services are governed by their own terms and privacy policies. We are not responsible for the practices of these third parties.

10. Intellectual Property

DriveHub, the DriveHub logo, and all content within the App are the intellectual property of ThePearlie Tech Co and are protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written permission.

11. Prohibited Use

You agree not to use DriveHub to:

• Engage in reckless or dangerous driving;
• Record video or audio of third parties without their consent where prohibited by law;
• Circumvent speed limits, evade law enforcement, or otherwise break the law;
• Attempt to interfere with the operation of our servers or other users' access to the App.

12. Disclaimer of Warranties

DriveHub is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by applicable law, ThePearlie Tech Co shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) DriveHub.

Our total liability to you for any claim arising from these Terms or your use of DriveHub shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless ThePearlie Tech Co and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of DriveHub, your breach of these Terms, or your violation of any law or third-party right.

15. Termination

We reserve the right to suspend or terminate your access to DriveHub at any time, with or without notice, if we reasonably believe you have breached these Terms. On termination, the licence granted in Section 2 ends immediately. Sections 5–14 and 16 survive termination.

16. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of DriveHub shall first be submitted to informal negotiation — email us at support@thepearlie.com and we will respond within 14 business days. If the dispute cannot be resolved informally, it shall be referred to the courts of competent jurisdiction in Nigeria.

Nothing in this section limits your statutory consumer rights under the law of your country of residence.

17. App Store and Google Play Additional Terms

If you downloaded DriveHub from the Apple App Store, you acknowledge that Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App. Apple is a third-party beneficiary of these Terms for the purpose of enforcing them against you.

If you downloaded DriveHub from Google Play, you acknowledge that Google is not a party to these Terms and has no obligation to provide any maintenance or support for the App.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page. If the changes are material, we will notify you in-app. Continued use of DriveHub after changes are posted constitutes your acceptance of the revised Terms.
